These General Terms and Conditions (GTC) apply to the entire business activities of Inspired Movement – Vitale (hereinafter referred to as “Inspired Movement”). Inspired Movement offers classes, workshops, and events in the fields of sport and nutrition.
All services and content are subject to the general contractual conditions of Inspired Movement. The services provided by Inspired Movement are intended to support the health and well-being of the customer but do not constitute therapeutic or medical treatment.
Inspired Movement offers participants various passes for different classes and validity periods. The specific services and validity periods of each pass are defined in the separate price list.
All Inspired Movement passes are personal and non-transferable and cannot be cancelled once purchased. The validity period of each pass is binding. Paid passes that are not used, or only partially used, expire after their validity period. There is no entitlement to a refund. The contract is concluded upon the purchase of a pass. In any case, a contract is deemed concluded when the participant makes use of the services offered by Inspired Movement and/or purchases products directly.
In exceptional cases (e.g. prolonged illness or accident), active passes may be suspended and extended for the duration of the absence. This must be communicated immediately in writing to: info@inspired-movement.com. In all cases, a medical certificate must be provided.
All passes can be extended for a fee of CHF 20.00 per week. Such extensions must be requested in writing via info@inspired-movement.com.
No training sessions will be refunded. Inspired Movement reserves the right to cancel sessions due to urgent or emergency circumstances. In such cases, the customer’s credit will not be forfeited.
All prices are stated in Swiss Francs (CHF) and include any applicable value-added tax (VAT). Inspired Movement reserves the right to change prices at any time. The prices valid at the time of contract conclusion, as stated in the Inspired Movement price list, shall apply.
Inspired Movement offers the following payment methods: credit card, invoice, TWINT, or cash.
Participants are required to pay the invoiced amount before the start of the class or course. Any rental fees for external venues (fitness centres, swimming pools, sports facilities, etc.) are not included in the price unless explicitly stated. Offsetting the invoiced amount against any claims the participant may have against Inspired Movement is not permitted. Inspired Movement reserves the right to withhold services or deliveries in the event of late payment.
If the invoiced amount is not paid by the due date, Inspired Movement is entitled to charge a late fee of CHF 30.00 per reminder until the outstanding amount has been settled.
A trial session may be purchased only once and only by persons who have not previously attended regular classes at Inspired Movement. Entry into classes is generally possible at any time by prior arrangement, provided that places are available and the participant is medically fit to train. The fee for the trial session must be paid in advance.
Subject to any differing agreement, Inspired Movement fulfils its obligations by providing the agreed services. Unless otherwise agreed, the place of performance shall be the specified training location of Inspired Movement.
The parties expressly reserve the right to engage auxiliary personnel to fulfil their contractual obligations. They shall ensure that any auxiliary personnel are engaged in compliance with all applicable legal provisions and any relevant collective labour agreements.
Any injuries, illnesses or changes in health condition must be reported to Inspired Movement prior to training. By participating in personal or group training sessions, the participant confirms that they are in good health and fit to train.In the event of complaints (e.g. sudden discomfort, dizziness, nausea, pain, injuries, heart palpitations, etc.), a physician must be consulted immediately and Inspired Movement must be informed as soon as possible. Inspired Movement assumes no liability for injuries sustained during training.
Registration for classes is the responsibility of the participant and must be completed independently via the website or the Inspired Movement app. The number of participants per class is limited. Available spots are displayed during registration on the website and in the Inspired Movement app.
Inspired Movement recommends registering as early as possible and reserving a spot in the desired class in a binding manner. If there are insufficient registrations (fewer than 3 participants for indoor classes or fewer than 5 participants for outdoor classes), Inspired Movement reserves the right to cancel the class. In such cases, participants will be notified personally in advance.
Cancellations of personal training sessions must be made at least 24 hours in advance. Cancellations of group classes must be made at least 12 hours in advance. Otherwise, the full class fee remains payable. This policy does not apply to family emergencies, illnesses or accidents.
In the event of absence due to illness or accident, a medical certificate must be provided.
The amount of the rescheduling fee (regular course price) depends on the time of rescheduling:
If absences or cancellations due to illness or accident are confirmed by a medical certificate, the missed session may, where possible, be rescheduled at a later date or the difference in course fees may be refunded.
If a replacement participant who meets the course requirements is named, the paid course fee may be transferred to the replacement participant. In principle, no refunds of course fees are granted for missed sessions.
Changes to the class schedule may occur at any time. There is no entitlement to refunds. Substitutions and holiday schedules are communicated via WhatsApp or the booking system.Inspired Movement reserves the right to reduce the number of classes during holiday periods. The validity of passes includes holiday weeks.
There is no guarantee that a class will always be led by the same instructor. Inspired Movement also reserves the right to cancel classes free of charge if there are insufficient registrations.
Participants are responsible for behaving in accordance with the conditions set by the facility operator. Used equipment must be cleaned and properly stored by the participant after use, particularly in cases of perspiration or injury.
Insurance coverage is the responsibility of the participant. Inspired Movement assumes no liability for accidents or illnesses. Participants are strongly advised to take out private liability insurance and accident insurance.
Participation in training sessions and other services provided by Inspired Movement is at the participant’s own risk and responsibility. Any claims of any kind – including claims for damages, injuries or consequential damages – arising in connection with participation in services offered by Inspired Movement are expressly excluded. Inspired Movement also accepts no liability for damage to property. The participant confirms that they are physically fit to take part in sports activities and is responsible for seeking medical advice regarding their state of health. If the participant chooses not to do so, this is at their own risk. Inspired Movement assumes no liability for health-related risks, including those that are unknown at the time, in the event of an accident or damage.
Inspired Movement is entitled to process and use personal data collected in the course of the contractual relationship for the purpose of fulfilling its contractual obligations. Inspired Movement takes all measures required by law to ensure the protection of personal data. The participant expressly agrees to the storage and contractual use of their personal data by Inspired Movement and acknowledges that Inspired Movement may be required or authorised to disclose such data to courts, authorities or third parties if legally obliged to do so. Unless explicitly objected to, Inspired Movement may use personal data for marketing purposes. Data necessary for the provision of services may also be passed on to commissioned service providers or other third parties. Personal data is used exclusively for internal purposes, order processing, communication and information. Inspired Movement will not pass personal data on to third parties for other purposes. Inspired Movement is entitled to publish photos and media recordings without the explicit consent of the participant. If a participant does not wish this, they must notify Inspired Movement in writing at info@inspired-movement.com
Inspired Movement reserves the right to amend these General Terms and Conditions at any time. The amended version shall enter into force 30 (thirty) days after publication on the Inspired Movement website. Unless the participant has expressly agreed to a newer version, the version of the General Terms and Conditions valid at the time of contract conclusion shall apply.
If the timely fulfilment of obligations by the company, its suppliers or third parties becomes impossible due to force majeure, such as but not limited to natural disasters, earthquakes, volcanic eruptions, avalanches, severe weather conditions, storms, wars, riots, civil wars, revolutions, uprisings, terrorism, sabotage, strikes, nuclear incidents or reactor damage, the company shall be released from its obligations for the duration of the force majeure event and for a reasonable start-up period thereafter. If the force majeure event lasts longer than 30 (thirty) days, Inspired Movement is entitled to withdraw from the contract. In such case, Inspired Movement shall refund any fees already paid in full. Any further claims, in particular claims for damages arising from force majeure, are excluded.
The place of jurisdiction is the registered office of Inspired Movement. This contract is governed by Swiss law. By making use of the services offered by Inspired Movement, the customer expressly agrees to these General Terms and Conditions in their entirety.
